In these Terms, “FridgeFam,” “we,” “us,” and “our” refer to the operator listed above.
1. Acceptance of Terms
By downloading, installing, or using FridgeFam (the “App”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the App.
2. Description of Service
FridgeFam provides collaborative grocery lists, meal planning, recipe storage, and household management, available in free and premium tiers via the Apple App Store.
3. Accounts
- You must be at least 13 years old to create an account.
- FridgeFam is not intended for children under 13, and we do not knowingly collect personal information from children under 13.
- Provide accurate, complete registration information and keep it updated.
- You are responsible for all activity under your account and for safeguarding your credentials.
- Notify us promptly of unauthorized access to your account.
4. Acceptable use
- Use the App only for lawful, personal purposes.
- Do not upload malware, attempt unauthorized access, or disrupt the App.
- Do not infringe intellectual property or privacy rights.
- Do not harass, impersonate, or abuse other users.
- Automated scraping, bots, or rate abuse are prohibited.
4.1 Prohibited content
You may not submit content that:
- Contains hate speech, slurs, or discriminatory language targeting race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Includes profanity, obscenity, or sexually explicit material.
- Threatens, harasses, or promotes violence against any person or group.
- Attempts to manipulate, exploit, or interfere with AI features (such as prompt injection, jailbreaking, or instructing the AI to bypass its guidelines).
- Contains malicious code, scripts, or instructions intended to exploit or damage the App.
We use automated content moderation to filter prohibited content. Content that violates these rules will be rejected, and repeated violations may result in account suspension or termination.
5. Households and sharing
- Creating a household makes you its owner with administrative rights.
- Household members can view shared lists, recipes, tags, birthdays (if provided), and activity.
- Owners may remove members at any time.
- Members are responsible for their actions within the household.
6. Subscriptions and pricing
FridgeFam offers free and paid subscription plans through Apple In-App Purchases. Pricing is shown in the App and in the Apple App Store, and may vary by region. Current plans may include:
- Free: $0, includes core features with ads. Limited to 1 household and 5 members maximum.
- Premium Monthly: $4.99/month, auto-renewing.
- Premium Yearly: $49.99/year, auto-renewing.
- Family: $7.99/month or $79.99/year, auto-renewing.
The Family plan provides Premium features for the purchasing account. Other household members may continue to see ads and do not inherit purchaser-only account entitlements (such as premium themes, app icon packs, or unlimited-household access) unless they purchase Premium individually.
Apple may change subscription pricing in accordance with its policies and will notify you where required.
We may change prices for new subscribers at any time. For existing subscribers, we will provide reasonable advance notice (in-app and/or by email) before changes take effect. By using the App, you consent to receive email notices about pricing, subscriptions, and other service-related updates.
7. Billing and trials
- Billing and subscription management are handled by Apple. Charges occur upon purchase confirmation.
- Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date.
- Free trials convert to paid subscriptions unless cancelled before the trial ends.
- Refunds must be requested through Apple; FridgeFam does not process refunds directly.
8. Content and data
- You retain ownership of content you submit. You grant us a license to store, process, and display it to operate the App.
- You are responsible for maintaining your own backups. While we back up data regularly, we are not liable for loss.
- Content must not violate third-party rights or include unlawful, offensive, or inappropriate material.
- We may remove or restrict content that violates these Terms.
9. Intellectual property
The App, including its design, features, and content, is owned by FridgeFam and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without permission.
10. Third-party services
The App uses third-party services such as Firebase (storage/authentication), Google AdMob (ads), and Apple services (payments, notifications). Their terms and privacy policies apply to your use of those services.
11. Advertising
Free tier users may see advertisements delivered by third-party ad providers (such as Google AdMob). Premium subscriptions remove ads for the subscribed account. Family subscriptions remove ads for the purchasing account only. Other household members may continue to see ads and retain free-tier personalization limits unless they purchase Premium individually.
12. Disclaimers
THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
FridgeFam does not provide medical, nutrition, or health advice. You are responsible for verifying ingredients and dietary needs, including allergies.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIDGEFAM SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.
14. Indemnification
You agree to indemnify and hold FridgeFam harmless from claims, damages, or expenses arising from your use of the App or violation of these Terms.
15. Termination
- You may terminate your account at any time in the App settings. Termination does not entitle you to refunds.
- We may suspend or terminate your account for violations of these Terms, fraud, or abuse.
- After account deletion, some data may remain in backups for a limited time.
- Household owners may lose access to shared household content if their account is deleted.
16. Changes to Terms
We may modify these Terms. We will notify you of significant changes in-app or via email. Continued use after changes means you accept the updated Terms.
17. Changes to the App
We may add, modify, or discontinue features; update pricing (with notice for existing subscribers); or update technical requirements.
18. Governing law and dispute resolution
- These Terms are governed by the laws of the State of Indiana, USA, without regard to conflict of law principles.
- Except for small claims court matters, any dispute will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- Arbitration will be conducted remotely (video/phone) unless an in-person hearing is required. If an in-person hearing is required, the location will be reasonably convenient for you, unless both parties agree otherwise.
- Arbitration will be conducted in English before a single arbitrator, and the award may be entered in any court with jurisdiction.
- You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@fridgefam.com with your account email and the subject “Arbitration Opt-Out.”
- Class and representative actions are not permitted; disputes must be brought individually.
19. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.
